Terms of use.

These terms govern your use of this website. This site presents general information about HYANS and how we coordinate and support yacht and ship agency work in Hawaiʻi. It is not an offer, a contract, or a promise of any particular result.

Scope

What this site is — and what it is not.

This website is provided for general information about HYANS and the maritime agency services we coordinate. Nothing on this site is an offer to contract, a quotation, a guarantee, or professional advice, and nothing here creates an agency, client, or advisory relationship on its own.

Any engagement between you and HYANS is governed by a separate written agency agreement, together with the specific scope, terms, and confirmations we set for your call. Where anything on this site differs from that agreement, the agreement controls. If you would like to engage us, please request maritime support and we will confirm scope in writing.

  • The site is informational and may be updated, changed, or removed at any time
  • Services are provided only under a separate written agency agreement
  • Descriptions of services are illustrative, not a fixed or guaranteed scope
  • We coordinate and support; authorities and third parties make their own decisions
No guarantees

Outcomes depend on authorities, third parties, and conditions.

HYANS coordinates, arranges, and supports maritime port calls. We do not control, and we do not guarantee, the decisions or availability of the parties a call depends on. Berth and port access, fuel and bunker supply, pilots, tugs and line handlers, vendors, provisioning, transport, pricing, and scheduling are all subject to third-party availability and current conditions.

Clearance, inspections, permits, and approvals rest with the responsible authorities — including U.S. Customs and Border Protection, USDA / APHIS, the U.S. Coast Guard, Port State Control, harbor masters, and other agencies. Weather and routing information is supporting information only; captains and operators retain full responsibility for navigation and for the safety of the vessel and crew.

Because of this, any timelines, availability, or results described or discussed are estimates and are not guaranteed. For ports, harbors, and channels, confirm current berth availability, draft limitations, operating status, and authority requirements before arrival.

Limitation of liability, in plain language.

This site is provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law. Questions

Frequently asked

Does using this site create a contract with HYANS?
No. This site is informational only. Any engagement is governed by a separate written agency agreement that sets the specific scope and terms of your call.
Do you guarantee berths, fuel, or clearance?
No. HYANS coordinates and supports these, but availability and approvals depend on authorities and third parties. We confirm current status and requirements before arrival rather than guarantee them.
Can the information on this site change?
Yes. Content — especially operational detail such as port status, draft, and authority requirements — can change without notice. Always confirm with HYANS and the relevant authorities before you rely on it.
